When This DPA Applies
This DPA applies when you (the Customer) are the data Controller and PlotSpark processes personal data on your behalf. This includes data about your end-users, members, or customers that you manage within PlotSparkOS. For data where PlotSpark is the Controller (your account, billing), our Privacy Policy applies.

This Data Processing Agreement ("DPA") forms part of the Terms and Conditions between:
"Processor": PLOTSPARK LTD, registered in England and Wales, ICO Registration: ZB985291 ("PlotSpark")
"Controller": The entity identified in your PlotSparkOS subscription agreement ("Customer", "you")
This DPA applies when PlotSpark processes Personal Data on behalf of the Customer as a Processor under UK GDPR and EU GDPR.
Subject Matter: PlotSpark processes Personal Data to provide the PlotSparkOS platform services.
Duration: Processing continues for the duration of the Customer's subscription plus any retention period specified in the Terms.
Nature and Purpose: Processing includes hosting, storage, display, transmission, and analysis of Customer Data to deliver the Services.
Categories of Data Subjects: Depending on Customer's use, may include: Customer employees/users, Customer's end-users/members/customers, and other individuals whose data Customer uploads.
Types of Personal Data: Names, contact information, account data, content uploaded, usage data, and other data determined by Customer's use of Services.
Special Categories: PlotSpark does not intentionally process special category data unless explicitly agreed in writing.
